The Turkish Patent Institute has recently implemented a change in regulation with respect to class 35 services.

Until the recent change, the translation of the sub-group of class 35 concerning retail / sales services was as follows:

(a) The bringing together, for the benefit of others, of a variety of goods, enabling customers to conveniently view and purchase those goods (such services may be provided by retail stores, wholesale outlets, means of electronic media, through mail order catalogues or other similar services).

It is now changed to:

(b) The bringing together, for the benefit of others, of ……………….. goods, enabling customers to conveniently view and purchase those goods (such services may be provided by retail stores, wholesale outlets, means of electronic media, through mail order catalogues or other similar services).

An applicant seeking protection for the afore-said services has to fill the blank area with relevant goods, a group of goods or the name of an industry.  If the service covers all goods and industries, the phrase “of a variety of” has to be used.

For example, one may file an application for (c) “The bringing together, for the benefit of others, of textile goods, enabling customers to conveniently view and purchase those goods (such services may be provided by retail stores, wholesale outlets, means of electronic media, through mail order catalogues or other similar services)”.

The above listed services will be considered to be different that the services listed in (a).  In other words, if a trademark is registered for (a), the same mark may theoretically be registered for (c) or for any other specification of service where the blank area is filled with relevant goods, a group of goods or the name of an industry.

For trademark owners who have registrations covering (a) in class 35, it would be recommended to file fresh applications under the new specification explained in (b) above.
